These Terms form a binding agreement between you and the operator of UnsentLettersWall.com. Do not use the service if you do not agree.
1. Acceptance and Eligibility
You must be at least 18 years old and legally able to enter a binding agreement. By visiting, creating an account, submitting content, or otherwise using Unsent Letters Wall, you agree to these Terms, the Privacy Policy, Community Guidelines, Disclaimer, DMCA Policy, and any additional rules shown during submission.
2. What the Service Provides
Unsent Letters Wall provides tools for writing, storing, moderating, displaying, organizing, sharing, and promoting user-submitted letters and related content. We do not guarantee publication, continued availability, confidentiality, emotional benefit, search ranking, audience response, or permanent preservation.
3. Public and Private Content
Public submissions are public. They may be indexed, cached, copied, screenshotted, archived, quoted, shared, or redistributed by other people and services. Private submissions are not promised to be legally privileged, clinically confidential, immune from technical failure, or exempt from lawful disclosure.
4. Ownership and License to Submitted Content
You retain any ownership rights you lawfully hold. By submitting content, you grant the operator, Unsently, and their affiliates, successors, licensees, service providers, contractors, distributors, and partners a non-exclusive, worldwide, perpetual, irrevocable to the maximum extent allowed by law, royalty-free, fully paid, sublicensable, and transferable right and license to use, host, store, cache, reproduce, publish, display publicly or otherwise, perform publicly or otherwise, distribute, transmit, syndicate, promote, advertise, excerpt, edit, moderate, redact, translate, reformat, modify, adapt, and create derivative works from the content, in whole or in part, in any format, technology, channel, product, service, or media now known or later developed.
This license includes social posts, share images, collections, compilations, editorial features, promotional materials, advertisements, email, video, audio, printed materials, archives, and successor products or services, with or without attribution and without additional payment, notice, approval, or permission.
5. Your Representations
You represent and warrant that you created the content or possess every right, permission, consent, and authority needed to submit it; the content does not infringe copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights; and the content complies with law and the Community Guidelines.
6. Moderation and Removal
We may review, reject, edit, label, restrict, preserve, disclose, remove, restore, archive, or refuse to distribute content at any time, with or without notice, for any lawful reason. We may use automated tools and human review. We do not accept a duty to monitor every submission and do not endorse user content.
7. Accounts and Security
You are responsible for your credentials and account activity. We may suspend or terminate accounts, limit features, or preserve records when we reasonably believe there is fraud, abuse, legal risk, safety risk, technical misuse, inactivity, or a violation of these Terms.
8. Prohibited Conduct
You may not scrape, harvest, reverse engineer, interfere with security, evade rate limits, automate submissions without written permission, impersonate others, upload malware, manipulate engagement, threaten users, retaliate against submitters, identify anonymous contributors, or use the service to investigate, stalk, shame, or contact a person described in a letter.
9. Copyright and Repeat Infringers
Copyright complaints must follow the DMCA Policy. We may remove material and terminate repeat infringers when appropriate.
10. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the operator, Unsently, affiliates, owners, officers, employees, contractors, service providers, licensors, successors, and agents from claims, losses, liabilities, judgments, penalties, costs, and reasonable attorneys’ fees arising from your content, conduct, violation of these Terms, or infringement of another person’s rights.
11. Disclaimers
The service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, availability, and results. The service is not therapy, medical care, crisis intervention, legal advice, or professional counseling.
12. Limitation of Liability
To the fullest extent permitted by law, the released parties will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, privacy, goodwill, opportunity, revenue, or profits; emotional distress; third-party conduct; publication or removal decisions; unauthorized access; or inability to use the service.
13. Governing Law and Venue
These Terms are governed by Texas law, excluding conflict-of-law principles. Unless applicable law requires otherwise, exclusive venue will lie in the state or federal courts serving the Texas county where the operator principally conducts business.
14. Changes, Severability, and Survival
We may update these Terms prospectively by posting a revised version. Continued use after the effective date means acceptance. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue.
